Blue Roan Ridge Farm Stallion Breeding Contract

 This Contract for the breeding season of 2011, made and entered into on (date): _______ is by and between Tim Antoine ( Blue Roan Ridge Farm), hereinafter Stallion Owner, and _________________, hereinafter designated Mare Owner. Mare Owner agrees to breed the Mare named:___________________, AQHA registration #______________to Mr Crowheart Hancock for the Stud Fee of 400.00 for a live foal, subject to the following conditions:

1)  A copy of the mares registration papers (front & back) along with 100.00 dollar booking fee( part of breeding fee) is due with this signed contract. The balance of the breeding fee plus all unpaid expenses ( including, but not limited to veterinary fees and board ) shall be paid prior to mare leaving the farm.

2)  In addition to the above breeding charge, the mare owner agrees to pay 4.00 dollar a day for feed and mare care.

3)  Veterinarian Certificate: Mare owner warrants that said mare is free from disease or infection that could be transmitted to other horses, and agrees to provide, upon arrival, a veterinarian certificate,  showing freedom from disease or infection. This should include proof of negative Coggins test for EIA within one year, proof of current vaccinations ( including tetanus, influenza, encephalitis,rabies rhinopneumonitis, West Nile virus and EVA.)  Mare must have a negative uterine culture and be in sound breeding condition.

4)  EVA (Equine Viral Arteritis) vaccine from Fort Dodge should be given 3 weeks prior to breeding.

5)  A live foal is guaranteed from this breeding. A live foal guarantee is defined as "foal able to stand and nurse for at least twenty-four (24) hours after birth."  To ensure live foal guarantee, Mare owner is stronly encouraged to vaccinate pregnant  mare with Pneumabort-K during the 5th, 7th, & 9th months of gestation; prevent mares ingestion of  fescue grass/hay for at least 3 months prior to expected delivery date of foal. Upon death of a foal, Blue Roan Ridge Farm shall receive a statement from the attending veterinarian which includes the vaccination dates of the bred mare, and shall state that the mare did not produce a live foal. If the mare dies or becomes unfit to breed, another mare may be substituted with the stallion owners consent.

6)  All parties agree the Stallion Owner, their agents or employees, are not liable for death, sickness, or accident including consequential damages caused to the mare. If the mare has a foal at her side, all above terms regarding health and care of the mare will apply to the foal as well. The mare owner is not liable for death, sickness or accident including consequential damages caused to the Stallion. _____/______(Initials of Parties)

7)  Should the Stallion be sold, die or become permanently unfit for breeding, the stud fee shall be refunded in full to the Mare Owner and the Stallion Owner shall be held blameless. 
  
8)  This Agreement  constitutes the entire Agreement between the parties. Any modifications or additions must be in writing and signed by all parties to this Ageement. No oral  modifications will be considered part of this agreement unless reduced to writing and signed by all parties before a notary.
